THE practice

The Hodes Law Firm’s priorities in its legal practice are, in order of importance:

Facilitating high quality patient care and effective and efficient operation by every client.

Furnishing legal and practical guidance to Firm clients in how best to achieve their strategic – and tactical – business needs.

Taking all necessary steps to assist clients in achieving optimal results in, among others, the following areas:

  • Integration of practitioners, practices and facilities by merger, acquisition and development of health care systems best suited to each client’s financial and operational needs.
  • Analysis and, if desirable, structuring or restructuring client governance mechanisms to maximize the quality and efficiency of corporate decision-making.
  • Devising mechanisms to ensure ongoing compliance with federal and State statutory and regulatory standards.
  • Advising clients presented with, or seeking to prevent, HIPAA and HITECH privacy and security issues.
  • Providing transactional assistance to clients in real estate and capital financing transactions.
  • Advising clients regarding the kind, form and content of CON and licensure applications and, upon client request, working with the New York State Department of Health and the U.S. Centers for Medicare and Medicaid Services to obtain expeditious approval of those applications.
  • Contracts, contracts, contracts and contracts.
  • Counseling clients regarding reimbursement, employment and medical staff issues, as applicable, that may arise in the course of operation of the client’s business.
  • Conducting or, again as applicable, representing clients in internal investigations and regarding audits and investigations by NYSDOH, OPMC, NYOAG, OMIG, HHS-OIG, CMS, FTC and DOJ.
  • Etc. - A related, if non-specific, catch-all category that  experienced providers, other practitioners and plans completely understand.
